General Terms and Conditions

GL design online shop is an information system designed for the presentation and sale of products to users. It is managed by the company AUGEO, trade and mediation, Rok Bukovec s.p., Pohorska 6, 3000 Celje (hereinafter the provider). The user is the person using the information system, thus a customer at online shop GL design.

The content and purpose of General Terms and Conditions

General terms and conditions of GL design online shop discuss the rights of buyers, the conditions of purchase and sale of products and business relations between the provider and the customer.

Terms and Conditions of GL design online shop have been prepared in accordance with the Consumer Protection Act (ZVPot) and international codes of e-commerce.

Conclusion of contract

General Terms and Conditions are, together with the completed order, considered a purchase contract between the provider and the customer. The buyer is therefore obliged to familiarize himself/herself with them prior to using and ordering and be in full agreement. By confirming the order, the buyer confirms that he is familiar with General Terms and Conditions.

Upon registration the buyer acquires a password and a user name that is equal to his e-mail. The username and password clearly define the buyer and connect him with the entered data. The buyer is obliged to ensure that only he or an authorized person on his behalf will use the password.

How to Order

Ordering via the Internet 24 (twenty-four) hours a day, every day of the year. The buyer chooses and orders items that are available in the online store.

In the process of buying the buyer can follow the following technical steps:

  • signing into the online store using the e-mail address or user password in the event that the buyer has previously created a user account;
  • search for a particular product in a range of products in the online store;
  • selection of a product for purchase;
  • adding of the selected product to the shopping cart;
  • determining the quantity of each product for purchase in the shopping cart;
  • review of the selected product price in a selected quantity;
  • selection of delivery method;
  • selection of payment method;
  • review of the contract with the chosen method of delivery of the product and charged expenses of delivery if it is not free
  • confirmation, submission and finalization of order.

Via a graphical user interface the buyer can, before submitting the order, easily and effortlessly:

  • see and check which products he chose and added to the shopping cart,
  • see and check the price of an individual product and the total price for the total quantity of each individual product,
  • change the selected quantity of each product and calculate the new price changes,
  • remove selected items he does not want to buy from the shopping cart.

Via a graphical user interface the buyer can, before confirming the order, easily and effortlessly:

  • change the chosen method of delivery,
  • change the chosen payment method,
  • check and confirm individual changes in the order.
Order accepted
After the order is submitted, the buyer receives an e-mail notification that the order is accepted. The buyer has the option of cancelling the order without any consequences within 1 hour of the receipt of the notice. Apart from the possibility of cancellation, the buyer cannot change the content of the order after it is submitted. The buyer can, at any time, access his web profile with comprehensive data about the status and content of individual orders.
 
Order confirmed
If the buyer does not revoke the order, the order goes into further processing. The provider checks the order and availability of the ordered products, and then either confirms the order or rejects it with a reason. To check the data and ensure the accuracy of the delivery, the provider might contact the buyer at the given number via telephone. The purchasing contract between the provider and the buyer is at this stage concluded.
 
Order shipped
Within the deadline the provider prepares and sends the ordered products and notifies the buyer via e-mail. The e-mail also informs the buyer about the product return policy and who to contact in case of a complaint or delay in delivery.

Contract archiving

The contract is concluded in Slovenian or English language. All contracts (accounts) between the provider and the customer are archived in electronic and written form at the headquarters of the provider, Pohorje 6, 3000 Celje. The customer can at any time obtain a copy of the contract by requesting it via e-mail info@gldesign-dogs.com.

Prices

All product prices are in EUR. VAT is not charged on the basis of paragraph 1 of Article 94 of the Law on Value Added Tax (we are not liable for VAT). The prices listed in GL design online shop do not include shipping costs.

Prices are subject to change without notice. Upon purchasing the prices that are valid at the moment of confirmation apply.

Payment

All payments are made in euro. The provider allows payment by:

  • by cash or debit card (Maestro, MasterCard, Visa, Amex…) collected on delivery by our courier (Slovenia only)
  • by bank transfer to the company account - advanced payment
  • via PayPal with debit or credit card
  • possibility to pay by debit or credit card via PayPal (PayPal for unregistered users),
  • with Credit or Debit Visa, Card MasteCard, Maestro, American Express, Discover.

Delivery

Overview of shipping costs is always available in GL design online shop under the section "Payment and Delivery." All costs associated with the import clearance of goods, including all import duties in accordance with the applicable legislation of the country of import are paid by the customer. These costs are not refundable in case of order cancellation or return of goods.

All orders are delivered as packages by contracting partners Pošta Slovenija (the post of Slovenia), GLS and DHL.

Orders received on Fridays after 7 pm, on Saturdays, Sundays or holidays will be treated as orders received on the first business day. The term of delivery shall commence on the date when the provider sends an e-mail notification to the customer informing them that the order has been shipped.

GLS (Slovenia, EU and other EU countries)

Before delivery, the GLS courier notifies the buyer at the number that the buyer provided when submitting the order (applies to Slovenia only). 

If at the time of the delivery the takeover of product and payment are not possible at the buyer’s address, the GSL courier leaves a notice with a contact number. 

Within four days the buyer has to agree with GL design company about a new date of delivery. If the buyer fails to do so, GLS courier once again tries to serve the package the following, fifth day since the first attempt at delivery. If the second attempt also fails, the shipment is returned to the provider and the buyer is obliged to cover all the direct costs of sending the object of purchase.

If the service is unsuccessful (or before the first service, if such are the instructions of the provider or the buyer), GLS Slovenia (applies to Slovenia only) can turn the package over to Package Store or Paketomat (Package machine). The buyer or the sender must agree with such delivery unless it has been agreed otherwise. If the package is left at the Package store, the GLS courier leaves the buyer a notice with information about the location of the package. Package commercial units are available to buyers through the web link of GLS delivery: https://gls-group.eu/SI/sl/gls-iskanje-parcelshop. If the buyer is not at the given address or not available over the phone while the delivery address is within 2 km radius from Package machine, the courier is allowed to leave the package there without any consent.

The delivery time is usually the next business day, as an exception later.

DHL (EU and other countries of the world)

If the takeover of the order is not possible at the buyer’s address at the time of delivery, the DHL courier leaves a written notice. The buyer has to agree with DHL company about a new date of delivery. If the buyer does not respond, the courier tries to make the delivery in the next delivering cycle. The third attempt at delivery is charged 5 EUR. If the package cannot be delivered, the buyer is obliged to cover all the direct costs of sending the object of purchase.

Post of Slovenia (Slovenia, EU, other European countries and the world)

If the takeover of the order is not possible at the buyer’s address at the time of delivery, the courier leaves a written notice about the arrived delivery and all information regarding where it can be picked up. The delivery will wait for the buyer at the nearest post office for 15 days. If the buyer does not pick up the delivery within 15 days, it will be sent back to the provider. In this case the buyer is responsible for all costs that are the result of shipping, storage or shipment return.

In case of late delivery the buyer has to inform the provider within 3 (three) days of expected delivery by e-mail at  info@gldesign-dogs.com.

The provider is not liable for any delays by delivery services Post of Slovenia, GLS and DHL.

The provider may change delivery prices at any time. The buyer can choose a different delivery service if the order is thus be executed more efficiently.

Delivery time

All GL design products are handmade and usually custom made, so delivery can take up to 30 days from order confirmation. The provider ensures that the products will be delivered within that period or sooner (normally within 7-14 days) if possible.

In the event that the products are not in stock or we are not able to deliver them within 30 days, you will be notified by e-mail or phone regarding the expected delivery date.

The delivery period commences on the day on which the supplier receives the full payment to the bank account indicated on the invoice or the estimate, except in case of payment on delivery.

If the products are not in stock or cannot be delivered within 30 days, the provider notifies the buyer about the estimated delivery date via e-mail.

The delivered products remain the property of the provider until the receipt of full payment of ordered products and all additional costs incurred in the concluded contract (submitted order).

Order cancellation

Buyers can cancel the order within 1 hour of placing it by sending an e-mail to info@gldesign-dogs.com with a postscript PREKLIC NAROČILA (ORDER CANCELLATION) and the number of the order they wish to cancel.

Right to withdraw from contract, returning products

Withdrawal from the contract is subject to general conditions and applicable statutory provisions. Article 43 of the Consumer Protection Act applies: ‘for distance or off-premises contracts the consumer has the right to within 14 day inform the company about withdrawal from the contract without having to give a reason for such decision’.
 
The buyer has the right to notify the provider and withdraw from the purchasing contract within 14 days after the takeover of the delivered products (return of the products by registered mail). The returned products have to be unused, undamaged, in the original, undamaged packaging. A copy of the original invoice must be enclosed.
 
The buyer is obliged to cover all the direct costs of sending the object of purchase.
 
The provider returns the entire purchase price of goods (excluding shipping costs) no later than within thirty days. The same payment method that was used with the first transaction is used for the refund, unless agreed otherwise. At the customer's request the provider can regard the purchase price (excluding shipping costs) as credit for the next purchase.

Risk-Free Purchase

The provider guarantees the buyer a risk-free purchase.

The buyer can exchange all products bought in online store, for a larger or smaller size number, within 14 days from the receipt of the order.

The provider has to be notified about the exchange at info@gldesign-dogs.com or by post at the providers address AUGEO, Rok Bukovec s.p., Pohorska 6, 3000 Celje – SI, and the products returned within 14 days of the receipt of the order.

Returned products must be unused, undamaged and in original, undamaged packaging. A copy of the original Invoice must be attached.

The buyer is obliged to cover all the direct costs of sending the product (from the buyer to the provider and then from the provider back to the buyer).

Products made by measure (Apparel for all breeds)

If the buyer has measured the dog incorrectly or with a deviation, we guarantee that we will make all the corrections and corrections at our expense so that the product will fit the dogs and is suitable for use.

The buyer must notify the provider with all corrections and changes that need to bemade to info@gldesign-dogs.com and return the products within 14 days of the receipt of the order.

The buyer is obliged to cover all the direct costs of sending the product (from the buyer to the provider and then from the provider back to the buyer).

Order and damaged shipment complaint

The buyer can complain if the products received are not the right ones, are in wrong quantity or colour or if the products otherwise deviate from the order.

The provider has to be notified about the complaint atinfo@gldesign-dogs.com or by post at the providers address AUGEO, Rok Bukovec s.p., Pohorska 6,3000 Celje – SI, and the product returned within 14 days of the takeover.

The returned products have to be unused, undamaged, in the original, undamaged packaging. A copy of the original invoice must be enclosed.

All claims that are incorrectly packed or have sustained visible mechanical damages during transport will be returned to the buyer at the buyer’s expense.

In the event that the shipment is physically damaged, lacks content or shows signs of opening, the buyer is obliged to initiate the complaints procedure within three days from the date of receipt. Along with a written complaint, the buyer must provide photos of the damaged shipment to info@gldesign-dogs.com .

The provider will, together with contractual deliverers, try to resolve the complaint as soon as possible. 

Warranty

All GL design products are handmade in accordance with the highest quality standards which is confirmed by the certificate of authenticity that is enclosed with every product. All GL design precious metal products are stamped with the stamp of precious metal purity in accordance with the Law on metrology and stamping office of Slovenia, Goldsmith’s stamp (AR) and GL design trademark stamp. The customer also receives a warranty statement when purchasing any products made from precious metals at GL design online store. 

The products have warranty if so indicated on the warranty card or certificate that comes with the product. This warranty is valid if the instructions on the warranty card or certificate are followed and on presentation of the certified copy of the warranty policy with the original invoice. The warranty periods are listed on the warranty or guarantee statement.

Warranty is not valid if:

  • the copy of the original invoice is not enclosed,
  • the damage on the product is a consequence of improper use, mechanical damages or improper interference,
  • incorrectly packaged products or those with a visible mechanical damage that occurred during transport.

The buyer is obliged to pay all shipping costs in case of invalid warranty. 

The deadline for the repair of a defect of the product in warranty is forty-five days from the receipt of the product. If repair is not possible, the product will be replaced by the same one or a similar one.  

Returns that are sent by parcel distribution should be packed as prescribed in cardboard packaging in which the product cannot be damaged or lose any properties in any way. All claims that are incorrectly packed or have sustained visible mechanical damages during transport will be returned to the buyer at the buyer’s expense.

Damage

All GL design products are made with the intention of safe and appropriate use. The provider does not accept any responsibility in case of any injuries that might occur to animals if the buyer uses the product incorrectly or leaves the dog unattended.

The provider does not accept any liability for damage caused by improper or negligent use of products.

Data currency

The provider commits to do their best regarding the accuracy, currency and completeness of the published data on the offer, products and prices in the GL design online shop, but does not assume any responsibility for the accuracy, currency and completeness.

The provider strives for the greatest possible degree of accuracy and currency of the published data, however, a reduced level of operation, input, transmission, or any other data handling can cause errors that might appear in GL design online shop.

If the buyer assesses that the displayed information is incorrect, he can notify the provider vie e-mail at info@gldesign-dogs.com. The provider also strives for the best possible operation of GL design online shop, but assumes no liability and warranty for smooth use. 

All data, visuals and other information materials in GL design online shop are of informative nature.

The provider reserves the right to change, add or remove content from GL design online store at any time and in any way, partially or in full, irrespective of the reason and without any prior warning or notification, and in doing so does not take any responsibility for the consequences of these changes. 

Confidentiality and personal data protection

Data provided by the buyer are strictly confidential and shall be treated in accordance with the Consumer Protection Act (ZVPot).

The provider strives in their operations for the correct use of personal data of buyers. In accordance with ZVPot, the company is committed to protecting the personal data of buyers. The provider commits to permanent protection of all personal data.

The provider will use the personal data solely for the purposes of contract fulfilment needs (sending of informative material, offers and invoices, and other necessary communication). The provider will not use the personal data of the buyer to send promotional e-mails or other unsolicited promotional material, except those promotional notices which the buyer orders or agrees upon. The provider commits to saving and using the collected data only as long as is necessary to achieve the purpose and exclusively for use and fulfilment of customer wishes, for which they were collected.

In case of cooperation of the provider with other companies that provide the provider with their services (e.g. order delivery, payment transactions, GL design online store hosting, etc.), these companies will have access only to the data that is pertinent to smooth implementation of their service. These companies commit that the information access will not be misused and will be used solely and exclusively (only) for the execution of their work.

Intellectual property rights

Based on the Law on Copyright and Related Rights (Off. Gazette no. 16/2007, pages 48, 49, 51) and the Act on Industrial Property, the company is, in the broadest sense, the holder of the material copyrights and industrial intellectual property rights of all copyright works that are in any way involved in GL design online shop. All rights reserved.

Under the Law on Copyright and Related Rights Act the use or reproduction of copyrighted work are permitted under the public's right to information, for educational purposes and for illustration, confrontation and referral in citation form, in the event that the author takes into account the mandatory indication of the source and authorship of the work.

The buyer may load from the server for home or personal use for non-commercial purposes the information and materials that appear in the GL design online shop but may not amend any copyright designations, other notices relating to intellectual property rights or notices of other rights.Downloading and printing of information and materials for viewing and reading for non-commercial purposes is permitted.Any copying, distribution, republishing, modification of the information and materials in GL design online shop, their reproduction, mailing and distribution by any means without the prior written permission of the provider is prohibited.

The responsibility of the provider is excluded for all cases when visiting and using the GL design online shop.

The provider and the authors of content published in GL design online shop expect the customers to comply with written provisions and laws on protection of privacy, intellectual property law and copyright law.

The provider will otherwise be forced to take action against the offender in case of discovery of abuses and law violations.

Complaints

In case of complaints, the buyer can contact the provider by e-mail at info@gldesign-dogs.com.

Following a complaint, the provider will, no later than within five working days, notify the buyer regarding the length of the appeal and keep the buyer informed of the proceedings. The provider commits to their best endeavours to resolve any disputes amicably.

The provider ensures customer support and help via a contact form, e-mail at  info@gldesign-dogs.com or telephone at +386 31518366 from Monday to Friday between 9 am and 7 pm.

Amendments to the General Terms and Conditions

The provider reserves the right to change or supplement the provisions of General Terms and Conditions at any time and without prior notice, to ensure compliance with applicable legislation and internal business documents. The date of publication on the internet is considered the date of the change. 

Settlement of disputes

The provider and the buyer commit to act in accordance with good governance. Their statements will be interpreted in good faith. The provider and the buyer will settle possible disputes amicably.

The competent court of Celje is otherwise in charge of dispute settling.

Availability and validity of the General Terms and Conditions

These General terms and conditions are published in GL design online shop and on premises where the provider operates.

General terms and conditions bind the provider and the buyer from the moment of written order confirmation or the conclusion of the contract.

General Terms and Conditions enter into force upon signing of the company director and are valid until they are amended or supplemented.
